## Employer Costs in New Zealand Explained

New Zealand employers contribute a minimum of 3.5% of gross pay to KiwiSaver for contributing employees, rising to 4% from April 2028. Employers also pay an industry-rated ACC Work levy; the 1.75% ACC Earners’ Levy is deducted from employees through PAYE, not paid by the employer. There is no separate employer payroll tax. The national adult minimum wage is NZD $23.95 per hour from 1 April 2026. Most hiring is straightforward, though the new contractor gateway rules and proposed leave-accrual changes are reshaping compliance. Here’s the breakdown.

#### All employees: KiwiSaver and auto-enrolment

Employers must contribute a minimum of 3.5% of gross pay to KiwiSaver for all contributing employees aged 18–64 (rising to 4% from April 2028). New employees are automatically enrolled unless they opt out between their second and eighth week of employment. The employer contribution is on top of wages and is not deducted from employee pay. The government contribution decreased to 25 cents per dollar (max NZD $260.72 per year) under the 2025 Budget changes, which came into effect from 1 July 2025.

#### Contractor classification and the gateway test

The Employment Relations Amendment Act 2025 introduced a statutory contractor gateway test to reduce misclassification disputes. Contractors must meet specific criteria to be lawfully engaged as contractors rather than employees. Misclassification is expensive and attracts penalties. The gateway test is the first thing we check for any New Zealand engagement.

#### Minimum wage and leave under the Holidays Act (for now)

The adult minimum wage is NZD $23.95/hour from 1 April 2026. Statutory annual leave is four weeks. The government is proposing to replace the Holidays Act with a new hours-based leave accrual model (Employment Leave Bill), though the timing is not yet final. Until then, the Holidays Act remains the law and leave compliance requires careful accrual tracking.

#### Work permits and skilled migration (visas)

Non-New Zealand residents need work permits under Immigration New Zealand’s accredited-employer system. Processing times vary by role and employment type. Specific industries and shortage areas qualify for streamlined pathways. The employer must meet visa obligations once the permit is approved.
