## Employer Costs in Poland Explained

Poland offers Western-European talent at Central-European cost. Employer ZUS social contributions run to roughly 19.48-22.14% of gross salary (pension 9.76%, disability 6.50%, accident 0.67-3.33%, the Labour and Solidarity Funds 2.45% and FGŚP 0.10%), plus PPK at 1.5% where the employee participates. Employees pay ~13.71% ZUS, a 9% health contribution and PIT income tax (12% up to PLN 120,000, 32% above), all withheld. The minimum wage is PLN 4,806 per month. As a planning rule, total employer cost is about 1.20 times gross. Here’s the breakdown.

#### Employer ZUS contributions (~19-22%)

The main employer cost is ZUS (Zakład Ubezpieczeń Społecznych) social insurance, totalling roughly 19.48-22.14% of gross salary on top of pay. It breaks down into pension insurance (9.76%), disability insurance (6.50%), accident insurance (0.67-3.33%), the Labour Fund and Solidarity Fund (2.45% combined) and the Guaranteed Employee Benefits Fund, FGŚP (0.10%). The accident rate is not a matter of sector alone: an employer registering up to nine insured people pays a flat statutory 1.67%, while one with ten or more is assigned an individual rate from its PKD activity group and ZUS IWA data — low-risk office, IT and professional-services employers sit near the 0.67% floor. The rate is reset every year on 1 April. Pension and disability contributions stop once annual earnings reach PLN 282,600 in 2026 (30x the projected average salary). As a working rule, multiply gross by about 1.20 to get total employer cost — a PLN 8,000 gross salary costs roughly PLN 9,640 before PPK. Contributions are due to ZUS by the 15th of the following month for employers with legal personality, such as a sp. z o.o.

#### Employee deductions, PIT and the tax-free amount

On the employee side, ZUS deductions of about 13.71% (pension 9.76%, disability 1.50%, sickness 2.45%) come out of gross, followed by a 9% health insurance contribution, then personal income tax (PIT). PIT is progressive: 12% on income up to PLN 120,000 a year and 32% above that, with a tax-free amount of PLN 30,000 a year (worth PLN 300/month in reduced withholding) applied when the employee files a PIT-2 declaration. Employees under 26 pay no PIT at all on employment income up to PLN 85,528 a year, applied automatically by the employer without the employee having to claim it. Note that the 9% health contribution has not been deductible from tax since 2022. We apply the correct reliefs so net pay is right — and Poland’s relatively low effective tax on middle incomes is part of what makes it attractive to talent.

#### PPK: workplace pension auto-enrolment

Employee Capital Plans (Pracownicze Plany Kapitałowe, PPK) is Poland’s workplace savings scheme. Employees aged 18 to 54 are automatically enrolled (those aged 55 to 69 can join on request, and participation closes at 70), with the employer contributing a minimum of 1.5% of gross remuneration and the employee 2% — both can add more, up to a further 2.5% and 2% respectively — plus state top-ups of a one-off PLN 250 welcome payment and PLN 240 a year. Employees can opt out but are automatically re-enrolled every four years, so participation drifts upward over time. The next auto-enrolment round falls in 2027: employers must notify by 28 February and contributions restart on 1 April unless the employee opts out again. Because it sits on top of the ZUS stack, PPK adds to the true cost of a participating employee — something first-time employers in Poland often miss. #### Contract types, leave and the Labour Code

Poland draws a sharp legal distinction between a full employment contract (umowa o pracę), which carries Labour Code protections and the full ZUS stack, and civil-law contracts (umowa zlecenie / umowa o dzieło), which are cheaper but tightly restricted — using a civil contract for what is really employment is misclassification. Article 22 of the Labour Code makes the relationship employment regardless of what the parties call the contract, and substituting a civil contract carries a fine of PLN 1,000 to 30,000 on top of reclassification and back contributions. Under the Labour Code, statutory annual leave is 20 days rising to 26 days after 10 years of service — and education counts toward that threshold, a university degree being worth 8 years, so most graduate hires reach the full 26 days after roughly two years of work. Paid public holidays come on top. Notice periods and termination are regulated and scale with tenure. Registering a Polish sp. z o.o. is quick on paper — the online S24 route reaches the KRS register in one to three business days. Becoming an operational employer is the slower part: VAT registration, a Polish bank account for a foreign parent, ZUS payer registration and payroll setup commonly take four to eight weeks together. And the lasting cost is what comes after — Polish statutory accounting, the accident-rate classification, contract-type compliance, management board liability, and the expense of winding the entity down if plans change.
