## Why hire in South Africa through an EOR

South Africa offers a large English-speaking workforce, working hours that overlap with Europe and statutory employer costs among the lowest anywhere. Hiring there without a South African company means using an Employer of Record. South African law treats that arrangement as a temporary employment service under the Labour Relations Act, which sets how long some assignments can last.

| Parameter | Statutory requirement | EOR management |
| --- | --- | --- |
| Legal basis | Temporary employment service under section 198 of the Labour Relations Act | TopSource is the employer; your hire works for you |
| Employer contributions | UIF 1% on pay up to R17,712 a month, SDL 1% and COIDA by industry class | UIF and SDL paid monthly with PAYE; COIDA assessed once a year |
| Pay up to R269,600.90 a year | After three months, the client is deemed the employer | Checked before the start date |
| Income tax | PAYE withheld monthly on the 2026/27 tables | Reconciled twice a year on the EMP501 |
| Notice | One to four weeks by length of service | Contracts written to the BCEA |

Figures for the 2026/27 tax year, verified in October 2026.

### Employed through a temporary employment service

In South Africa an EOR arrangement falls under the rules for temporary employment services in section 198 of the Labour Relations Act: we employ and pay your hire, who works for you. Those rules also make the client share liability if the employer breaches the BCEA or a bargaining council agreement.

### The three-month rule below the threshold

For employees earning up to R269,600.90 a year, an assignment longer than three months makes the client their employer under the Labour Relations Act, as the Constitutional Court confirmed in 2018. Above that threshold the rule doesn’t apply. We check where each role falls before the start date.

### Low statutory costs

There is no employer social security, pension or health contribution. The employer pays UIF at 1% on pay up to R17,712 a month, SDL at 1% of all pay and COIDA by industry class: about 1.1% to 2.2% of salary in professional services.

### Bargaining councils follow your sector

Whether a bargaining council agreement covers your hire depends on the sector and area your company is in, not ours. Where an extended agreement applies, its pay rates, provident fund and levies come on top. We confirm this before the first hire.

### No external company registration

A foreign company that is party to even one employment contract in South Africa must register as an external company with CIPC within 20 business days. Through an EOR, the employment contract is with TopSource, not with your company.

## Hire in South Africa without setting up an entity

South African payroll is light on contributions and heavy on filings. Employer UIF, SDL and COIDA come to about 1.1% to 2.2% of salary in professional services, but PAYE, UIF and SDL are declared every month on the EMP201 and reconciled twice a year on the EMP501, and UIF needs its own registration and monthly declarations with the Department of Employment and Labour.

The structure matters as much as the payroll. Under the Labour Relations Act, an Employer of Record is a temporary employment service. For employees earning up to R269,600.90 a year, an assignment longer than three months makes the client the employer, and the employee must be treated on the whole no less favourably than the client’s own staff doing similar work. Above that threshold, about R22,467 a month, the rule doesn’t apply and the EOR stays the employer for as long as the role lasts.

TopSource employs your team in South Africa. We issue a contract under the Basic Conditions of Employment Act, add your hire to our PAYE, UIF and COIDA registrations, run payroll and file every return, so you can hire in South Africa without setting up a company.

## How EOR in South Africa works: the process through TopSource

Step 1

### Check the role and the salary

We confirm the job, the salary and what your company does. The salary tells us whether the three-month rule for lower earners applies, and your sector tells us whether a bargaining council agreement does.

Step 2

### Issue the contract

Your hire gets a contract and written particulars of employment under the Basic Conditions of Employment Act, covering pay, hours, leave, probation and notice.

Step 3

### Register and onboard

We add your hire to our PAYE, SDL and UIF registrations with SARS, declare them to the UIF and cover them with the Compensation Fund from day one.

Step 4

### Run payroll every month

PAYE is withheld on the 2026/27 tax tables, and PAYE, UIF and SDL are paid with the EMP201 within seven days of month end. We reconcile on the EMP501 twice a year and issue an IRP5 to every employee.

Step 5

### Support the relationship day to day

Your account manager and the employee have a direct line for leave, sick notes, parental leave, notice, disciplinary procedure and anything else that comes up.

## Know your South Africa hiring costs before you commit

Tell us the role, the salary and what your company does. We’ll send back the full employer cost, and whether any sector rules apply, within one business day.

R30.23

## Employer Costs in South Africa Explained

A South African employee costs very little in statutory contributions: about 1.1% to 2.2% of salary in professional services, because there is no employer social security, pension or health levy. On R600,000 a year the employer pays R2,125 of UIF, R6,000 of SDL and R1,080 of COIDA, R9,205 or 1.53%. What raises the cost is the package: medical aid and a retirement fund are common in professional roles, and a bargaining council agreement can add more.

#### UIF, SDL and COIDA in 2026/27

Unemployment insurance is 1% from the employer and 1% from the employee on pay up to R17,712 a month, a ceiling unchanged since June 2021, so the employer pays at most R177.12 a month. The skills development levy is 1% of all pay with no ceiling. The Compensation Fund assessment under COIDA is paid by the employer alone, at a rate set by industry class, from 0.18% for professional services to 3.34% for rock drilling and blasting, on earnings up to R668,000 a year from 1 March 2026. UIF and SDL are paid with PAYE on the EMP201 within seven days of month end; COIDA is assessed once a year on the Return of Earnings. Since 1 April 2026, the COID Amendment Act has replaced criminal prosecution with administrative penalties. Our [South African payroll guide](https://topsourceworldwide.com/global-payroll/south-africa/)
 covers each contribution in detail.

#### Temporary employment services and the three-month rule

South African law treats an Employer of Record arrangement as a temporary employment service under section 198 of the Labour Relations Act: the EOR employs and pays the employee, who works for the client. The EOR must give the employee written particulars of employment, and the client and the EOR are jointly and severally liable if the EOR breaches the BCEA, a sectoral determination or a bargaining council agreement. Whether a bargaining council agreement applies is decided by the client’s sector and area. Since 2015, section 198A has added a rule for employees earning up to the BCEA threshold, R269,600.90 a year from 1 May 2026: work for a client for longer than three months is no longer a temporary service, the client is deemed the employer and must treat the employee on the whole no less favourably than its own staff doing similar work. In Assign Services v NUMSA (2018), the Constitutional Court held that the client then becomes the sole employer, and ending an assignment to avoid the rule counts as a dismissal. Above the threshold the rule doesn’t apply. For a role below the threshold, we agree the approach with you before the start date.

#### PAYE, the tax year and the filing calendar

The tax year runs from 1 March to the end of February. PAYE is withheld monthly on brackets from 18% to 45%, after a primary rebate of R17,820, so an employee under 65 pays no tax on income up to R99,000 a year. Budget 2026 adjusted the brackets and rebates fully for inflation, the first full adjustment since 2023, and raised the cap on retirement fund deductions from R350,000 to R430,000. Employers declare and pay PAYE, UIF and SDL on the EMP201 within seven days of month end, reconcile on the EMP501 for March to August in September and October and for the full year in April and May, and issue an IRP5 to every employee. Late reconciliation costs 1% of the year’s PAYE for each month, up to 10%.

#### Leave, notice and dismissal

Annual leave is 21 consecutive days a year, 15 working days on a five-day week. Sick leave is the number of days the employee would work in six weeks, 30 on a five-day week, over each 36-month cycle, and family responsibility leave is three days a year. Since a Constitutional Court ruling of 3 October 2025, parental leave is four consecutive months where one parent is employed, or four months and ten days shared where both are; the employer must hold the job open but isn’t required to pay for the leave. Employees earning up to R269,600.90 a year also have ordinary hours of 45 a week and overtime at time and a half. Notice is one week in the first six months, two weeks up to a year and four weeks after that. A dismissal needs a fair reason and a fair procedure, retrenchment needs consultation and at least one week’s pay for each completed year of service, and the CCMA can award up to 12 months’ pay for an unfair dismissal, 24 if it is automatically unfair. The national minimum wage is R30.23 an hour from 1 March 2026.

## EOR or entity setup: which one fits your South Africa plan?

Setting up in South Africa means a private company registered with CIPC, a South African bank account, a public officer resident in South Africa and your own registrations with SARS, the Department of Employment and Labour and the Compensation Fund. A foreign company that employs someone directly must also register as an external company within 20 business days. An EOR makes sense while you test the market or hire a first small team. Your own company makes sense once headcount and permanence justify the overhead, and for roles below the earnings threshold that you want to keep for longer than three months.

| Factor | TopSource South Africa EOR | Your own South African entity |
| --- | --- | --- |
| Speed to hire | Days | Weeks to register the company, SARS, UIF and COIDA |
| Set-up | None | CIPC company, bank account and resident public officer |
| Roles paid up to R269,600.90 a year | Up to three months, then the client is deemed the employer | No time limit |
| Best fit | 1-10 employees, market entry | Scaled, permanent operations |

### Consider an EOR if you’re:

1. Testing the South African market before setting up a company
2. Hiring a first small team in Johannesburg, Cape Town or remotely
3. Hiring for roles paid above R269,600.90 a year
4. Needing PAYE, UIF, SDL and COIDA running from the first month

## Frequently asked questions

### Is an Employer of Record legal in South Africa?

Yes. South African law treats it as a temporary employment service under section 198 of the Labour Relations Act: the EOR employs and pays the employee, who works for the client. For employees earning up to R269,600.90 a year, an assignment longer than three months makes the client the employer; above that threshold the EOR can employ them for as long as the role lasts.

### What is the three-month rule for EOR employees in South Africa?

Section 198A of the Labour Relations Act limits temporary service to three months for employees earning up to the BCEA threshold, R269,600.90 a year from 1 May 2026. After that, the client is deemed the employer, and the Constitutional Court held in 2018 that it becomes the sole employer. The employee must be treated on the whole no less favourably than the client’s own staff doing similar work. The rule doesn’t apply to employees earning above the threshold.

### What does an employee cost in South Africa?

Statutory employer costs are about 1.1% to 2.2% of salary in professional services. On R600,000 a year the employer pays R2,125 of UIF, R6,000 of SDL and R1,080 of COIDA, R9,205 in total. Medical aid, a retirement fund and any bargaining council contributions come on top where they apply.

### Does a foreign company need to register in South Africa to hire there?

If it employs someone directly, yes: under the Companies Act, a foreign company that is party to an employment contract in South Africa must register as an external company with CIPC within 20 business days. Through an EOR, the employment contract is with the EOR. The exception is a role paid up to R269,600.90 a year that lasts longer than three months, where the client is deemed the employer.

### What notice periods apply in South Africa?

Under the Basic Conditions of Employment Act, notice is one week in the first six months of employment, two weeks up to a year and four weeks after that. A dismissal also needs a fair reason and a fair procedure, and retrenchment requires consultation and severance of at least one week’s pay for each completed year of service.

### EOR or our own South African entity: which should we choose?

An EOR wins on speed and cost of entry: no company, bank account, public officer or registrations of your own. Your own entity wins on scale, and for roles paid up to R269,600.90 a year that you want to keep for longer than three months. Many clients start with an EOR and move the team to their own entity once South Africa is proven.
