Cafeteria Plan (Belgium)

What is a cafeteria plan?

A cafeteria plan (plan cafétéria / cafetariaplan), or flexible remuneration plan, lets Belgian employees choose how to use part of their pay package, swapping a budget for benefits from a list the employer sets. The cost to the employer is usually meant to stay the same, while the employee gets a package that fits their situation better.

How it works

The employer decides the scope of the plan: who can join, which budget can be converted and which benefits are on offer. The budget often comes from the end-of-year premium, and several joint committees, including 111, 209, 226 and 330, have opened partial conversion of that premium. Mobility options such as a bicycle are common, and in practice plans often include three or four benefits. Many employers use one choice period each year, sometimes keeping mobility benefits open all year round.

Belgium has no specific law on cafeteria plans. They rest on contractual freedom, within labour, tax and social security law, which leads to some key limits:

  • the employee’s agreement must be voluntary and recorded in writing;
  • legal and sector minimum pay and conditions must be respected;
  • each benefit keeps its own tax and social security rules, and the two do not always value it the same way;
  • not every group of employees can always use the budget flexibly, and exclusions should be explained clearly.

The federal government agreement of 2025 announced a legal framework and a limit on converted pay of 20% of annual gross salary. As of October 2026, we have not found an adopted text, so check the position before setting up a plan.

Risks to plan for

A poorly structured plan can lead to reassessments by the National Social Security Office, the tax authorities or labour inspectors. Advisers often suggest considering a tax ruling or a position from the NSSO on complex plans. Indirect costs, such as administration, also affect the budget, and the plan should say what happens if an employee resigns, retires or falls ill during the year.

The 2025 government agreement announced a limit of 20% of annual gross salary, but we have not found an adopted text as of October 2026.
