What is Kündigungsschutz?

Kündigungsschutz refers to the statutory protection against dismissal in Germany. Governed by the Kündigungsschutzgesetz (KSchG), it prevents employers from terminating contracts without a legally valid reason. This law applies if:

  • The employee has worked for the company for more than six months.
  • The company employs more than ten full-time equivalent employees.

The Three Justifications for Dismissal

Under Kündigungsschutz, a dismissal is only valid if it is “socially justified” based on one of three areas:

  1. Behavioral (Verhaltensbedingt): Based on misconduct, such as a breach of contract.
  2. Personal (Personenbedingt): Based on the employee’s inability to perform the role (e.g., long-term illness).
  3. Operational (Betriebsbedingt): Based on business necessity, such as restructuring. This requires a “Social Selection” to ensure the most vulnerable workers are not unfairly targeted.

Strict Procedural Rules

Even with a valid reason, a termination can be overturned if procedures are not followed:

  • Written Form: A termination notice must be a physical document with an original “wet ink” signature. Digital signatures are not sufficient.
  • Works Council: If a works council exists, it must be consulted before the notice is issued.
  • Action Period: Employees have three weeks from the receipt of the notice to challenge the dismissal in a labor court.

Practical Impact
